1. What This Service Is

Paint by Us (“we,” “us,” operated at paintbyus.com) provides an automated software service that converts personal photographs into custom, numbered paint-by-numbers coloring canvases, vector SVGs, and printable PDF documents. By accessing or using our website, you agree to be bound by these Terms of Service.

2. Your Photo & Content Ownership

You retain 100% ownership and all intellectual property rights to any photograph you upload. You confirm and warrant that you own or have the lawful authorization to use, convert, and reproduce the uploaded photo.

In-Memory Processing: Your photo is transmitted securely via HTTPS solely for automated computer vision processing and vector generation. We do not store, archive, or retain your original photo file on our persistent disks or database. Once vector generation completes, the original uploaded photo is permanently purged from server memory.

3. Generated Artwork Output

The coloring canvas, vector paths, and color swatch keys are algorithmically generated based on your input photo and selected palette settings. Because a paint-by-numbers canvas is inherently a stylized, simplified reduction of a continuous-tone photograph, we do not warrant that the output will capture every minute visual nuance of the original photo. A live preview is presented prior to checkout so you can inspect the result before purchasing.

4. Payments, Merchant of Record (Paddle) & Digital Delivery

All digital sales and payment transactions on Paint by Us are processed and fulfilled by our Merchant of Record:
Paddle.com Market Ltd (“Paddle”), Judd House, 18-29 Mora Street, London, EC1V 8BT, United Kingdom.

  • Merchant of Record: Paddle is the legal merchant and seller of record for your purchase of the Paint by Us Digital Pack. When purchasing, Paddle’s Buyer Terms of Use and checkout terms apply alongside these Terms.
  • Global Tax & Currency: Paddle manages global sales tax, VAT, and GST calculation, collection, and remittance.
  • Pricing: The purchase price is $2.99 USD (or local currency equivalent including applicable local tax). This is a single, one-time payment for instant digital delivery. There are no recurring subscriptions or hidden recurring fees.
  • Immediate Digital Performance & Statutory Waiver: In accordance with consumer protection regulations (including Directive 2011/83/EU and the UK Consumer Contracts Regulations), consumers of digital content normally receive a 14-day statutory right of withdrawal. Because your custom PDF and SVG files are delivered immediately upon payment, checkout requires your express consent to immediate digital delivery and your acknowledgement that your 14-day statutory withdrawal right is waived once digital file access is granted. Please refer to our Refund Policy for technical refund eligibility.

5. Acceptable Use

You agree not to upload content that is unlawful, defamatory, obscene, infringing on third-party trademarks or copyrights, or that contains malicious code or exploits. We reserve the right to refuse service or terminate access for violations of these terms.

6. Warranty Disclaimer

The service is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including merchantability or fitness for a particular purpose.

7. Limitation of Liability

To the maximum extent permitted by applicable law, our total cumulative liability to you for any claims arising from or related to the service shall be limited to the total amount paid by you for the specific digital order giving rise to the claim.

8. Governing Law & Consumer Protection

These Terms shall be governed by and construed in accordance with the laws of India, and subject to the jurisdiction of the competent courts in Nagpur, Maharashtra, India.

Mandatory Consumer Protection Notice: If you are a consumer residing in the European Union, United Kingdom, or United States, nothing in these Terms deprives you of the protection afforded to you by mandatory statutory provisions of the consumer protection laws of your country of habitual residence.
